Georgia Mitchell reserves the right to review and change any of the Terms by updating this page at its sole discretion. Any changes to the Terms take immediate effect from the date of their publication.
My typical work hours are Monday through Friday from 9 am to 5 pm (although hours may vary from time to time).
I try to have all weekends, holidays, and special family occasions off.
During your project, we will primarily use email and a web-based project management program to communicate and share files. This helps me keep everything organized and in one place. I do my best to reply to all communication regarding active projects within 24 hours (during my office hours).
If you need to chat via phone/skype or have an in-person meeting, you can schedule an appointment. Scheduling calls keep my work from being interrupted and allow me to focus on your project!
Each website will include a small credit to Georgia Mitchell, this design credit must remain in the footer!
Proofing & Revisions
I have built two revisions into all of my design packages. My goal is to have quality communication with you along the way. So, with any revision, we are closer to the perfect design. If a project does take more than two revisions there will be an additional charge for each revision (at my discretion) on your final invoice. I will also allow edits to your website for up to 24 hours beyond the completion date. Beyond this period of time, there will be an hourly service fee for me to go in and change things.
Agreed Scope, Price, Project Delays and Client Liability.
Any projects, services and rates supplied are limited to what is specifically outlined in the proposal and based on a set number of hours. Any additional services will require an agreed quote on extra hours. We reserve the right to adjust our hourly rates at any time.
Changes and additions outside the scope of the proposal are quoted and invoiced. You will be advised on all costs, changes and additions before the commencement of the additional work. Expenses are itemised on each invoice.
Any time frames or estimates that we give are contingent upon your full co-operation and complete and final content in photography for the work pages. During development, there is a certain amount of feedback required to progress to subsequent phases. It is necessary that a single point of contact be appointed from your side and be made available on a daily basis to expedite the feedback process.
Yes, we have a contract that will be provided to you and must be signed before any projects can be started. It explains in detail these terms and conditions.
PAYMENTS, REFUNDS AND CANCELLATIONS
The Client agrees to indemnify and reimburse Georgia Mitchell for any critical Client requested costs and expenses necessary for the completion of the project. Examples would be:
- Purchase of specific fonts at the Client’s request.
- Purchase of specific photography at the Client’s request.
- Purchase of specific software at the Client’s request.
30% deposit upon contract acceptance.
30% before the first draft review.
30% before the second draft review.
10% balance due before the site goes live.
Any payments not received within seven days will halt work until the payment is received. If payment is late twice during the project, we retain the right to ask for prepayment of hours or to end the project, whichever is deemed more fitting for the situation.
The Client understands that, unless alternate arrangements have been agreed upon, unpaid balances are subject to collection. In the event of collection, the Client will be liable for all costs of collection including attorney’s fees, court costs, and collection agency fees.
My goal is to make sure that you are 100% in love with your final project! I will do everything that I possibly can to make sure that you are happy. However, due to the nature of design work no refunds will be issued, no matter the point in the design process. This includes deposits paid for future scheduled work.
Sometimes things just simply don’t go the way we expect them to, If at some point, either of us decides our working relationship is failing, then we can submit the desire to part ways in writing.
Please keep in mind that the deposit will be forfeited. In the event this amount is not sufficient to cover Georgia Mitchell for time and expenses already invested in the project, additional payment will be due. If additional payment is due, this will be billed to the Client within fourteen (14) days of notification in writing to stop work.
Once the payment has been made for the work completed, I will send you all the files that have been completed so far, so that you can continue to build on your website without having to start from scratch again.
Supply of Materials
You must supply all materials and information required by us to complete the work in accordance with an agreed specification. Such materials may include but are not limited to, photographs, written copy, logos and other printed material. Where there is any delay in supplying these materials to us which leads to a delay in the completion of work, we have the right to extend any previously agreed deadlines by a reasonable amount.
Where you fail to supply materials, and that prevents the progress of the work, we have the right to invoice you for any part or parts of the work already completed.
Deadlines & Homework
With each project, I will assign client homework and give you deadlines to complete it. This homework will include the content and images for the pages that I am designing for you. It MUST be finished for your project to start. If your project design day arrives and you have not met your deadline, we will reschedule your project with an additional fee. If your 2nd project start deadline comes and you are still not prepared, we will not reschedule again. The contract will be terminated, and you will forfeit all payments made.
Copyrights & Trademarks
The Client represents to Georgia Mitchell and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Georgia Mitchell for inclusion in the Client’s website are owned by the Client. The Client has permission from the rightful owner to use each of these elements and will hold harmless, protect, and defend Georgia Mitchell and its subcontractors from any claim or suit arising from the use of such elements furnished by the Client.
Limitation of Liability
The Client agrees that any material submitted for publication will not contain anything leading to the abusive or unethical use of the Web Hosting Service, the Host Server or Georgia Mitchell. Abusive and unethical materials and uses include, but are not limited to, pornography, obscenity, nudity, violations of privacy, computer viruses, harassment, any illegal activity, spamming, advocacy of illegal activity, and any infringement of privacy.
The Client at this moment agrees to indemnify and hold harmless Georgia Mitchell from any claim resulting from the Client’s publication of material or use of those materials.
It is also understood that Georgia Mitchell will not publish information over the Internet which may be used by another party to harm another. Georgia Mitchell will also not develop any unlawful website for the Client. Georgia Mitchell reserves the right to determine what is and is not illegal.
